TRAX Registration

Program participants are invited to attend business meetings and participate in recreational and entertainment activities so long as they agree to the following assumption of risk and exculpatory clause. Program participants represent that they agree to the following declaration, which is written in the first person to reflect each participant’s personal agreement:

ASSUMPTION OF RISK
By attending the meeting I am indicating my desire to participate in the Trax Insurance, Ltd. Program (“Program”). My participation in the meeting includes, but is not limited to: travel to and from the meeting and social activities, including travel arranged on my own or arranged on my behalf; business meeting activities of the Program; and voluntary social activities offered for my recreation and entertainment (“Meeting”). If I so choose to participate in the Meeting, I understand that I do so knowing that my participation involves risks. These risks include, but are not limited to: acts of God; terrorism; use of roads, trails, vehicles, boats, or other means of conveyance that may not be operated or maintained to customary standards; high altitude; accident or illness without ability to rapidly evacuate or receive medical supplies; inadequate medical attention; physical exertion for which I may not be prepared; consumption of alcohol; property loss and/or damage; and personal injury and/or death, including personal injury or death due to others’ negligent acts or omissions and/or defective equipment. Trax Insurance, Ltd., Captive Resources, LLC, Kensington Management Group, Ltd., insurance brokers and other service providers and their respective officers, directors, members, management, employees, partners, advisors, agents and other various parties (collectively referred to as “Sponsors”) make no representations, express or implied, concerning the safety of the Meeting or the condition, quality or capabilities of either the equipment or the quality or capabilities of providers of any Meeting activities. I acknowledge that such risks may exceed those I accept generally, yet I choose to freely participate. I agree to accept all such risks and agree that Sponsors shall not be held responsible for any consequences of such Meeting risks, including without limitation injury or death from Sponsors’ own negligence. I agree that if any part of this agreement is not enforceable, the remaining parts remain in full force and effect.

AS BETWEEN MYSELF AND SPONSORS, I AGREE TO BE SOLELY RESPONSIBLE FOR MY OWN WELFARE, AS WELL AS THE WELFARE OF ANY MINORS UNDER THE AGE OF 21 PARTICIPATING IN THE MEETING WITH ME, AND ACCEPT ANY AND ALL RISKS.

RELEASE

For being permitted to participate in the Meeting, I hereby fully and forever WAIVE, HOLD HARMLESS, RELEASE AND FOREVER DISCHARGE SPONSORS, THEIR EMPLOYEES, DIRECTORS, AGENTS AND OTHERS ASSISTING OR THOSE OTHERWISE AFFILIATED WITH THE PROGRAM FROM ANY AND ALL CLAIMS, ACTIONS, DAMAGES, DEMANDS, EXPENSES, ATTORNEY FEES, AND SUITS OF EVERY KIND, NATURE OR DESCRIPTION WHATSOEVER ARISING OUT OF OR RELATED TO MY PARTICIPATION IN THE MEETING, INCLUDING, WITHOUT LIMITATION, ANY LIABILITY RELATING TO SPONSORS’ OWN NEGLIGENCE. I agree that by participating at Sponsor’s expense in the Meeting this release will not only bind me but will also bind minors under the age of 21 participating with me, my heirs and legal representatives, successors and assigns.
